Machel Montano & Motto Being Sued For Copyrights?

It is alleged that the King of Soca, Machel Montano & Soca star Lashley Winter aka ‘Motto’ of St. Lucia are being sued for copyright infringements of their 2019 soca hit ‘Issa Vibe’.

According to Dominica News Online (DNO), the suit was filed by Derek ‘Rah’ Peters of the WCK (Windward Caribbean Kulture) Band in February 2020. The WCK Band is a Dominican music band well known for many hits, including the popular 1995 release ‘Balance Batty’ which is the song that the copyrights allegations are being made.

 

 

Derek, who is the sole lyricist and co-composer of ‘Balance Batty’ says that he gave no permission, directly or indirectly, for the rights to reproduce or sample his work. According to DNO, the statement of the claim alleges:

 “The statement of claim alleges that videos were made of the musical work ‘Issa Vibe’ incorporating ‘Balance Batty’. These videos were uploaded to the YouTube video hosting site and made available to the public by Montano and Winter without his authorization. These unauthorized uploads infringed his right of communication to the public with respect to the musical work and the sound recording. Audio-only versions of the song were also uploaded to the Soundcloud audio hosting site without his authorization thereby creating further infringements.”
